The Residence Permit for Family Members of Spaniards is a separate authorization, not based on roots, intended for foreign nationals who maintain a direct relationship with a Spanish citizen and need to regularize or stabilize their situation in Spain. Its objective is to protect family unity and comply with European rulings that require Spain to guarantee family life for Spanish citizens with their loved ones.

According to the new Regulation and Instructions SEM 2/2025, the following family members of a Spanish citizen may apply for this permit: ✔️ 1. Spouse or registered partner of a Spaniard Includes marriage and registered stable partnership. ✔️ 2. Unregistered couple with a stable relationship Stable cohabitation or having a child in common must be demonstrated. ✔️ 3. Minor children of a Spanish citizen This includes adopted children or those under legal guardianship. ✔️ 4. Dependent adult children If there is a demonstrable disability or economic dependency. ✔️ 5. Dependents of the Spanish citizen As parents of the Spanish speaker, if they are financially dependent on him/her. Important: These cases are NO LONGER processed based on family ties. The current “family ties” policy is only available to family members of EU/EEA/Swiss citizens who are not Spanish.
