IS IT AN AUTOMATIC REGULARIZATION?
No. The Official State Gazette (BOE) itself makes it clear that permits are not granted automatically or collectively . This is an extraordinary , but individual , procedure where each person must apply and demonstrate specific requirements .
TWO EXTRAORDINARY WAYS (NOT JUST ONE)
The Official State Gazette (BOE) clarifies that there is not a single permit , but two different paths within the Immigration Regulations:
1. Applicants for international protection (asylum) Persons who applied for asylum before 1 January 2026 and whose application:
is still in process or
It has been rejected/denied, but they allow access to this exceptional route.
2. Extraordinary Rooting : Aimed at people in an irregular situation who:
They were already in Spain before January 1, 2026 .
prove 5 months of continuous residence , and
can demonstrate employment ties, family ties or a situation of vulnerability .
WORKING FROM THE BEGINNING: KEY CLARIFICATION
One of the most important (and least explained) points:
You can work legally from the moment your application is accepted for processing , without waiting for the final decision. This includes both employed and self-employed work , which makes a huge difference compared to other immigration processes.
VERY IMPORTANT DEADLINES
It is not an indefinitely open process .
Start: April 16, 2026
End: June 30, 2026
Applications cannot be submitted outside of this deadline, except in the event of regulatory changes (which do not exist at present).
REQUIREMENTS THAT CANNOT BE SKIPPED

No criminal record (in Spain and previous countries of residence)
Not to pose a risk to public order
Prove identity
Prove presence in Spain before 1/01/2026
